1. Introduction and Acceptance
These Terms and Conditions ("Terms") govern your access to and use of the BookMyPhysio.lk website and related services (the "Platform"). By creating an account, booking a session, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
2. Description of Service
BookMyPhysio.lk is an online appointment setting platform:
- to search for and book home-visit physiotherapy sessions with independent Practitioners.
- to list Practitioner services, manage availability, and receive bookings through the Platform.
We act as an intermediary facilitating these connections. We are not a party to the clinical service agreement formed between a Patient and a Practitioner upon booking; that agreement is between the Patient and Practitioner directly.
3. Eligibility and Accounts
3.1. You must be at least 18 years old to create an account. Bookings for minors or dependents must be made by a parent, legal guardian, or authorised caregiver who accepts these Terms on the minor's behalf.
3.2. You agree to provide accurate, current, and complete information when registering and to keep this information updated.
3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorised use.
4. Practitioner Obligations
Practitioners using the Platform represent and warrant that they:
- Hold all qualifications, registrations, and licences required by Sri Lankan law to practise physiotherapy independently;
- Will provide accurate information regarding their credentials, specialisations, and availability;
- Will carry their own professional indemnity/liability insurance, where applicable, and maintain it for the duration of their listing;
- Will comply with applicable professional codes of conduct and patient confidentiality obligations;
- Will deliver services with reasonable skill and care consistent with their professional obligations; and
- Are engaged as independent contractors, not employees or agents of BookMyPhysio.lk.
Practitioners are solely responsible for their clinical decisions, treatment plans, and any consequences arising from the care they provide.
5. Patient Obligations
By booking a session, you agree to:
- Provide accurate medical history, current symptoms, medication information, and any relevant health conditions to the Practitioner;
- Ensure a safe, accessible, and appropriate physical environment for the home visit (e.g., adequate space, lighting, and a responsible adult present if the Patient is a minor or requires assistance);
- Treat Practitioners with respect and refrain from any abusive, discriminatory, or unsafe conduct; and
- Disclose any known infectious illness prior to the visit so appropriate precautions can be taken.
We reserve the right to suspend or terminate accounts of Patients or Practitioners who violate these obligations.
6. Bookings, Fees, and Payments
6.1. Pricing. Session fees are set by each Practitioner and displayed prior to booking confirmation. BookMyPhysio.lk does not charge Patients a separate service/booking fee.
6.3. Cancellations. Any amendments to a booking including cancellation, rescheduling, or location change are to be settled directly between Patient and Practitioner.
7. Reviews and Ratings
Patients may leave reviews of completed sessions. Reviews must be honest, based on direct experience, and free of defamatory, abusive, or discriminatory content. We reserve the right to remove reviews that violate this policy.
8. Intellectual Property
All content on the Platform, including text, logos, design, and software, is owned by or licensed to BookMyPhysio.lk and protected under Sri Lankan and applicable international intellectual property law. You may not copy, reproduce, or distribute Platform content without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any loss, injury, or damage arising from the clinical conduct of a Practitioner.
- We are not liable for indirect, incidental, special, or consequential damages.
10. Indemnification
You agree to indemnify and hold harmless BookMyPhysio.lk from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or (for Practitioners) your provision of clinical services.
11. Termination
We may suspend or terminate your account at our discretion, with or without notice, for conduct that we believe violates these Terms, poses a risk to other users, or is fraudulent or harmful. You may close your account at any time.
12. Dispute Resolution
12.1. Patient-Practitioner Disputes. Disputes regarding the quality or conduct of clinical care should first be raised with the Practitioner directly.
13. Changes to These Terms
We may update these Terms from time to time. Continued use after changes take effect constitutes acceptance.
